Terms of Use

Scope

These Terms of Use ("Terms") are between you and Neon Tiger Labs LLC ("we", "us", or "our"), a California limited liability company, and govern your use of neontigerlabs.com (the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms govern the studio website only. Neon Tiger Labs products have product-specific terms and App Store licence terms. If a product-specific term conflicts with these Site Terms about use of a product, the product-specific term controls for that product.

What the Site provides

The Site provides information about Neon Tiger Labs, our shipped products, press materials, support and contact routes, and links to product websites, the App Store, GitHub, and other third-party destinations. The Site is informational and does not itself sell apps, subscriptions, or other products.

Product information

We try to keep product descriptions, screenshots, availability, pricing references, and links accurate. Product features and commercial terms may change. The current App Store listing and the purchase surface shown before an App Store transaction are authoritative for a specific purchase. Product-specific privacy policies and terms remain authoritative for the corresponding product.

Press materials

Logos, screenshots, product images, and other press materials made available through our press page may be used for truthful editorial, review, news, or commentary about Neon Tiger Labs or the relevant product, provided the material is not altered in a misleading way and your use does not imply an endorsement, sponsorship, or partnership that does not exist.

Our names, logos, product names, artwork, and other brand assets remain the property of Neon Tiger Labs LLC or their respective owners. No broader trademark or commercial-use licence is granted by making press materials available.

Acceptable use

You agree not to use the Site to violate law or another person's rights, interfere with the Site's operation or security, attempt unauthorized access, scrape or overload the Site in a manner that materially disrupts service, or falsely represent that you are affiliated with or endorsed by Neon Tiger Labs.

Intellectual property

The Site, including its text, design, code, artwork, branding, and original media, is owned by Neon Tiger Labs LLC or its licensors and is protected by applicable intellectual-property law. Except for the limited press-material permission above and rights that applicable law gives you, no licence is granted to reproduce, redistribute, sublicense, or commercially exploit Site content.

Third-party services and links

The Site links to third-party services and uses third-party providers described in our Privacy Policy. We do not control third-party sites, services, availability, terms, privacy practices, or content. Your use of a third-party destination is governed by that provider's own terms.

Email submissions

If you send us a message, you represent that you have the right to send its contents. You retain ownership of material you submit. You permit us and our service providers to process the message as reasonably necessary to receive, review, respond to, secure, and maintain appropriate business records for the communication, as described in our Privacy Policy.

Site changes and availability

We may change, suspend, or discontinue Site content or features at any time. We do not promise that the Site, any particular page, or any third-party link will remain available indefinitely.

Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEON TIGER LABS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SITE OR THESE TERMS. TO THE SAME EXTENT, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SITE OR THESE TERMS WILL NOT EXCEED US$100.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except to the extent mandatory consumer law in your place of residence provides otherwise. Any court proceeding must be brought in a court with lawful jurisdiction over the dispute.

Changes to these Terms

We may update these Terms as the Site or legal requirements change. We will update the effective date above and, where appropriate, provide additional notice of material changes. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by applicable law.
